When we refer to a "Merchant" or "Merchants," we mean individuals or entities (e.g., a corporation, limited liability company, partnership, sole proprietors, etc.) that use the Application for purposes of offering you products, services, and information. We do our best to make our terms understandable to you by defining them along the way and using capitalized terms to represent repetitive concepts in our policies. Any capitalized term not defined in this Privacy Policy have the meanings set forth in our Terms of Service.

Types of Data collected
We collect select types of information regarding you in order to permit you to use the Application. This section explains the types of data that we may collect from you.

Device permissions for use of the Application by Users

In order to use the Application, you must provide the following information:

1. The month and year of your birth. You are not required to provide the day of their birth, and we recommend that you do not provide such information. Your month and year of birth is necessary to ensure that you are of sufficient age to use the Application.

2. Identify a User Name. A User Name is the means by which the Application identifies you; however, your User Name does not, and should not, contain any Personally Identifiable Information ("Personal Information"). Personal Information is information that identifies or could assist in identifying you, such as without limitation, your name, social security number, driver's license number, etc. For instance, the User Name cannot be an email and should not include any of your Personal Information. This is an important and unique part of the Application; the Application does not need your User Name to identify who you are with the use of Personal Information. The User Name is necessary for you to access the Application.

3. Identify a Screen Name. The Screen Name is how you will appear to other Users using the Application. Like a User Name, the Screen Name should not be your actual name or contain any Personal Information.

4. Identify your desired language and culture preference. For instance, if your preferred language is English, but you prefer the Queen's English dialect of the English language, you could identify your preferred language as English and culture as England.

5. Identify only one of the following: the User’s (i) City, (ii) State, or (iii) Country.

The Application requests that you identify your gender as male, female, or nonbinary. You, however, may elect to not disclose your gender.

The Application maintains a record of all communications and transactions made by you during your use of the Application. The Application also maintains a Privacy Control Page specific to you on which you can review all communications and transactions made by you during your use of the Application.

Depending on your specific device, the Application may request certain permissions that allow it to access your device Data as described below.

By default, these permissions must be granted by you before the respective information can be accessed. Once the permission has been given, you can revoke it at any time. In order to revoke these permissions, you may refer to the device settings or contact us for support at the contact details provided above.

The exact procedure for controlling app permissions may be dependent on your device and software. Please note that the revoking of such permissions might impact the proper functioning of this Application. If you grant any of the permissions listed below, the respective Personal Information may be processed (i.e., accessed to, modified or removed) by this Application.

Device permissions for use of the Application by Merchants
Merchants using the Application must provide the information required by the Owner as a condition precedent to using the Application for a commercial purpose. Merchants conducting business on the Application are distinguished from Users due to the commercial nature of their use of the Application. If you are using the system as both a User and a Merchant, the terms of this Privacy Policy apply to your use of the Application as a User. A separate Merchant policy ("Merchant Policy") governs the use of the Application by Merchants.

Data Collected through the Use of the Application.
When you use the Application, we collect information about your activity on and interaction through the Application. We may use this Data in an anonymous, aggregated, or pseudonymized form that does not identify you individually. We may use this Data to evaluate, provide, protect or improve the Application, including developing new products and services.

Among the types of information that this Application collects, by itself or through third parties, there are: Usage Data; Approximate location permission (non-continuous); Camera permission, with your consent to save or record; Write-only Photo Library permission.

Complete details on each type of information collected are provided in the dedicated sections of this Privacy Policy or by specific explanation texts displayed prior to the Data collection.

Personal Information may be freely provided by you or, in the case of Usage Data, is automatically collected when using this Application. Personal Information is generally any information that identifies you individually, such as without limitation, your name, address, social security number, email address, phone numbers, etc. The Application does not require you to provide Personal Information in order to use it. We strongly recommend that you do not provide Personal Information when using the Application or to other Users through the use of the Application. To the extent that you provide us Personal Information, such Personal Information is administered in accordance with this Privacy Policy.

Unless specified otherwise, all Data requested by this Application is mandatory, and failure to provide this Data may make it impossible for this Application to provide its services. The Application will indicate to you what types of Data are mandatory for the Application to function properly. In cases where the Application states that a form Data is not mandatory, you are free not to communicate this Data without consequences to the availability or the functioning of the Application.

The Application uses a single cookie in order to function properly. A cookie is a small text file created by a website that is stored on your computer, either temporarily or permanently, that allows the website to recognize you and track your preferences. By using the Application, you can access other websites and third-party services. It is important to understand that these other websites and/or third-party electronic services may use cookies or collect Personal Information. The Application neither controls nor maintains the privacy policies and cookie policies of third-party services used or accessed by you through the use of the Application. Hence, you must consult with the privacy policies and cookie policies of any third-party services used or otherwise accessed by you through the Application to understand and consent to the policies of those third-party services.

You are responsible for any third-party Personal Information obtained, published or shared through the Application, and you confirm that you have the third party's consent to provide any such Personal Information to the Owner. Personal Information of third-parties is not required to access or use the Application, and we recommend against you providing any third-party Personal Information in connection with your use of the Application.

Mode and Place of Processing the Data

Methods of Processing
We take appropriate security measures to prevent unauthorized access, disclosure, modification, or unauthorized destruction of the Data. Data includes all information that you may provide or collect in connection with the use of the Application.

We maintain administrative, technical, and physical safeguards intended to protect against accidental or unlawful destruction, accidental loss, unauthorized alteration, unauthorized disclosure or access, misuse, and any other unlawful form of processing of Personal Information in our possession. It is important to understand that while no electronic service is one hundred percent (100%) secure, we do our best to ensure the security of your information.

Data processing is carried out using computers and/or IT enabled tools, following organizational procedures and modes strictly related to the purposes indicated. In addition to the Owner, in some cases, the Data may be accessible to certain types of persons in charge, involved with the operation of this Application (such as without limitation administration, sales, marketing, legal, system administration) or external parties (such as without limitation third-party technical service providers, mail carriers, hosting providers, IT companies, communications agencies) appointed, if necessary, as Data Processors or service providers by the Owner. The updated list of these parties may be requested from the Owner at any time.

Legal Basis of Processing

Except as otherwise required by law applicable to you, we may process information relating to Users if one of the following applies:

- Users have given their consent for one or more specific purposes. Note: Under some legislations, the Owner may be allowed to process Personal Information until the User objects to such processing ("opt-out") without having to rely on consent or any other of the following legal bases. This, however, does not necessarily apply, whenever the processing of Personal Information is subject to European data protection law, the California Consumer Privacy Act of 2018 ("CCPA") or amendments thereof. In such instances, your consent must be given in accordance with the controlling jurisdictional law. - Processing is related to a task that is carried out in the public interest or the exercise of official authority vested in the Owner;
- Processing is necessary for the legitimate interests pursued by us or by a third-party. Where necessary we may process your Data for a third party's legitimate interests.

We do not sell any of your Personal Information or Data. However, we may disclose Information or Data collected in response to lawful requests by public authorities, such as to meet national security or law enforcement requirements.

The Application allows You to communicate with others (such as without limitation individuals and businesses); however, we caution you against providing Personal Information to others through your use of the Application. We cannot, and do not, control whether you provide Personal Information to others through your use of the Application. Once Personal Information is communicated by you to another through the Application, we cannot control whether that Personal Information is used by, sold to or shared with others.

In the event you have questions, we will try to help clarify the specific basis that applies to the processing, and in particular whether the provision of Personal Information is a statutory or contractual requirement, or a requirement necessary to enter into a contract.

Place
The Data is processed at the Owner's operating offices and in any other places where the parties involved in the processing are located.

You are also entitled to learn about the legal basis of Data transfers to a country outside the European Union or to any international organization governed by public international law or set up by two or more countries, such as the UN, and about the security measures taken by the Owner to safeguard their Data.

End User’s Personal Information
If you use the Application and collect Personal Information of other users, you are responsible for what you do with the Personal Information collected either directly or indirectly through the Application. If this is the case, you are solely responsible for complying with any laws and regulations that apply to your collection and use of your End Users' information, including Personal Information, that you collect either directly or indirectly through the Application.

Your End Users' payment information may be processed via third party eCommerce Payment Processors with which you integrate your Account, in accordance with such eCommerce Payment Processors' terms and policies. We do not collect or store your End Users' payment information.

Retention Time
We retain records of your use of the Application along with any Personal Information for as long as your Account is active or you elect to delete all of the information. We also retain Personal Information for as long as necessary to achieve the purposes described in this Privacy Policy and as required by law.

Once the retention period expires, all Data shall be deleted. Once deleted, the Data is permanently eliminated and cannot be recovered. Therefore, the right to access, the right to erasure, the right to rectification and the right to data portability cannot be enforced after expiration of the retention period.

The Purposes of Processing
The Data concerning you is collected to allow us to provide the Services accessible through the Application, as well as for the following purposes: Platform services and hosting, Hosting and backend infrastructure, and Device permissions. For instance, we may use your Data for the following purposes:

- Customizing the Services. Provide you with customized services. For example, we may use your location information to determine the location and offers of merchants in your geographic vicinity consistent with your intentions identified in the Application.

We do this based on anonymous, pseudonymized or aggregated information which does not focus on you individually.
- Security. Ensure the security and integrity of the Application.
- Third-Party Relationships. Manage our vendor and partner relations.
- Enforcement. Enforce our Terms of Service and other legal terms and policies. For instances, Users do not have the right to use the Application for any illegal purpose or purpose contrary to the terms and conditions of use of the Application.
- Protection. Protect our and others' interest, rights, and property.
- Complying With Laws. Comply with applicable laws and requirements.

Approximate Location Permission (non-continuous)
Used for accessing the Your approximate device location. This Application may collect, use, and share Your location Data to provide location-based services.

Your geographic location is determined in a manner that isn't continuous, and only with your consent. This means that this Application does not derive your approximate position on a continuous basis.

Camera Permission
Used for accessing Your camera or capturing images and video from the device.

Camera Permission, Without Saving Or Recording
Used for accessing Your camera or capturing images and video from the device. This Application can save or record the camera output.

Write and Read Photo Library Permission
Allows write and read access to the User's photo library.

The Rights Of Users
You may exercise certain rights regarding Your Data processed by the Owner. In particular, You have the right to do the following:

- Withdraw Your consent at any time. You have the right to withdraw consent where you have previously given your consent to the processing of your Personal Information.
- Object to processing of Your Data. You have the right to object to the processing of your Data if the processing is carried out on a legal basis other than consent. Further details are provided in the dedicated section below.
- Access Your Data. You have the right to learn if Data is being processed by the Owner, obtain disclosure regarding certain aspects of the processing and obtain a copy of the Data undergoing processing.
- Verify and seek rectification. You have the right to verify the accuracy of your Data and ask for it to be updated or corrected.
- Restrict the processing of Your Data. You have the right, under certain circumstances, to restrict the processing of your Data. In this case, the Owner will not process your Data for any purpose other than storing it.
- Have Your Personal Data deleted or otherwise removed. You have the right, under certain circumstances, to obtain the erasure of their Data from the Owner.

- Important: The Application allows You to delete all of your Data voluntarily. If you delete your Data, neither the Owner nor Application can recover the Data. Once deleted, your Data is gone and nonrecoverable.
- Lodge a complaint. You have the right to bring a claim before their competent data protection authority.

Where Personal Information is processed for a public interest, in the exercise of an official authority vested in the Owner or for the legitimate interests pursued by the Owner, Users may object to such processing by providing a ground related to their particular situation to justify the objection.

Users must know that, however, should their Personal Information be processed for direct marketing purposes, they can object to that processing at any time without providing any justification. Any requests to exercise User rights can be directed to the Owner through the contact details provided in this document. These requests can be exercised free of charge and will be addressed by the Owner as early as possible and always within one month.

CALIFORNIA CONSUMER PRIVACY ACT – CALIFORNIA CIVIL CODE §1798.100, ET AL.
The California Consumer Privacy Act ("CCPA") grants California consumers ("consumer[s]" or "California User[s]") specific legislative protections governing the collection and use of their Personal Information. This Privacy Policy provides a general description of those rights. Owner encourages California Users to consult California Civil Code §1798.100, et al. to review the entire statutory text of the CCPA.

The Privacy Policy is updated every twelve (12) months. Consumers may submit written requests under the CCPA to Us via email, U.S. mail, or overnight courier (such as FedEx, UPS, etc.). We are not obligated to provided information disclosed pursuant to Civil Code §§1798.110 and 1798.115 to a consumer more than twice in 12 months.

California law requires us to disclose certain information regarding the categories of Personal Information we collect. We have not collected any Personal Information from California Residents within the twelve (12) months preceding the effective date of this Privacy Policy. Within the twelve (12) months following the effective date of this Privacy Policy, we expect to collect the following types of Personal Information:

- Your activity conducted through the Application;
- Location Information for purposes of allowing other Users, including merchants, to offer You products and services.
- Other information that may identify or can be reasonably associated with you.

Each category of information is collected for the following business purposes: (i) providing the services offered through the Application; (ii) providing customer support for the services offered through the Application; (iii) operating the Application; (iv) communicated with you; (v) customizing services; (vi) securing and protecting the services offered through the Application, including without limitation auditing the services, bug and fraud detection, protection and prosecution of security incidents or illegal activity; (vii) enforcing our terms and policies; (viii) complying with applicable laws; (ix) other business purposes about which we may notify You from time to time.

Requests For Information
With certain exceptions and restrictions, the CCPA provides California Residents the right to submit requests to a business that has collected their Personal Information: (a) to provide them with access to the specific pieces and categories of personal information collected by the business about such California Resident, the categories of sources for such information, the business about such California Resident, the categories of sources of such information, the business or commercial purposes for collecting such information, the categories of third-parties with which such information was shared; and (b) to delete such Personal Information. If you ask us to delete your Personal Information, we will delete it; however, once deleted your information cannot be recovered.

The Application also allows you to view all of Your Data and transactions made through the Application, as well as delete all such Data and transactional records. This may be done by navigating to the privacy controls through the consumer profile. California Residents may also designate an authorized agent to make requests for deleting their Data. To designate an authorized agent to request to delete your Data, you must provide a valid power of attorney, the requester's valid government-issued identification, and the authorized agent's valid government-issued identification.

Sale Of Personal Information
We do not sell your Personal Information. We have not sold any personal information to third parties for a business or commercial purpose in the twelve (12) months preceding the effective date of this Privacy Policy.

We Do Not Discriminate Against You
You have the right not to be discriminated against for exercising certain of your rights. We do not discriminate against California residents for exercising their rights.

The User's Personal Data may be used for legal purposes by the Owner in Court or during the stages leading to possible legal action arising from improper use of this Application or the related Services.

The Owner reserves the right to make changes to this Privacy Policy at any time by giving notice to its Users on this page and possibly within this Application and/or as far as technically and legally feasible.
